Mail-Order Brides and The Law

While the idea of ordering a partner off the internet may not appeal to all of us, it certainly appeals to some. The number of agencies that offer such a service indicates there is a burgeoning market for mail-order brides, highlighting a legal question about how they come to stay with their new husbands.

Since the recession began in 2008, our doors have pretty much been tightly closed. Immigration is heavily restricted and only the most valuable immigrants are allowed in, and only after a lengthy consultation and bureaucratic process.

So how does one get a mail-order bride into this country?

To enter the United States, the bride must obtain a K-1 visa. She may be your wife-to-be, but she is also an immigrant, and will be treated as such in the eyes of the law. Currently, you will need form I-129F, with the United States Citizenship and Immigration Services (USCIS) office that has jurisdiction over where you live.

You will need to prove that you are a legal US citizen, that neither of you are married, and that you have an existing relationship between you and your bride-to-be. In the eyes of the law, proving a previous relationship will involve demonstration of contact between the two parties. That can be letters, emails, airline tickets, boarding passes, passport stamps and other correspondence. The law requires two years’ worth of evidence to consider a K-1 visa.

Once the visa is approved thanks to your awesome lawyer, the future bride will be required to provide a range of information and evidence that she is who she says she is, has no criminal record and supporting documents. These documents include; a valid passport, birth certificate, divorce or death certificate for any previous spouse, police certificate from all places lived since age 16, medical examination, vaccination records, evidence of financial support, proof of valid relationship with the petitioner and photographs.

The consular officer managing the case will do legal checks and ensure the person and the application is genuine. This could take a few weeks, so patience is a virtue, like any aspect of the law.

Entry

Once the visa is approved, you must marry within 90 days of her entering the country. Failure to do this results in her deportation, and probably the end of the relationship. At the best of times, reapplication is viewed dimly, now that’s even more true.

Once married, your new wife is classified as an alien spouse. Immediately after marrying, you should apply for an Adjustment of Status, Form I-485, for your wife to become a permanent resident. They will also need to apply for a work permit, to allow them to work legally.

The K-1 visa process can be a long and drawn out one. It is relatively easy if you and your intended follow the rules and keep up with the required documentation. It’s easier still if you use one of the many immigration lawyers around. They can do in moments what it might take you days to achieve.

How not to articulate compliment

Senator Joe Biden has bitten a bullet this week, and it could be the defining moment of his second presidential run. Ironically, Biden described Barrack Obama as “articulate” in the most inarticulate form, said many African-American leaders including the irreverent reverend Al Sharpton.

Notebook, being an Asian, raised both eyebrows. Here’s a quick check for the dictionary on “articulate:”

1. uttered clearly in distinct syllables.

2. capable of speech; not speechless.

3. using language easily and fluently; having facility with words: an articulate speaker.

4. expressed, formulated, or presented with clarity and effectiveness: an articulate thought.

Biden probably referred Obama as an articulate speaker, but that is beside the point. Biden is articulate and so as Hillary Clinton, so why didn’t Clinton get the same treament? The comment struck many in the black community as a racial slur, wrote Lynette Clemetson. If one attributes a feat on a black man they would not otherwise on a white man, that isn’t right.

But isn’t turning a compliment into a political flash point a cheap tactic? Why, all of the sudden, Biden is viewed suspiciously when he complimented his opponent?

Don’t know. But all seemed frivolous.

What Are Lanyards?

Lanyards are pieces of materials that can be attached to an object to keep it secure. Usually you will find lanyards used for keeping a pair of glasses from falling off of your head, or attached to an axe or hatchet and wrapped around the wrist so the when a person swings that hatchet, it doesn’t accidentally come out of your hand and go flying.

Lanyards have been used extensively in the military. Hundreds of years ago, they were used to keep swords, pistols and other weapons from falling off calvary troops, or those in the Navy. They could be easily detached and reattached at one or both ends. This made it easier to use the weapon, but also made sure it didn’t fall off a person’s body when they were riding or walking around.

There are many different kinds of lanyards these days, and they can be used to solve all sorts of problems. They can be used for glasses, but they also help coaches on the playing field keep track of whistles, stop watches and other items. Those people that camp and hike a lot may keep a compass or fire starter on a lanyard, looped around their neck, to make sure they not only don’t lose these valuable pieces of equipment, but also to keep them handy when they want to find out where they are or need to light a fire.

Lanyards can be made from a variety of different materials. In history they were made from a natural fiber like hemp. Hemp was actually used in a variety of useful items, lanyards, ropes, and even clothes. As more synthetic fibers were created, lanyards were made from these materials instead. They are cheaper to make, which keeps overall costs down. Man made materials can also be stronger in some cases, but if a person is buying lanyards, they have to make sure that the lanyard they want to use is large and strong enough to secure they item. For an example, a lanyard that is used for keeping a whistle on the wrist isn’t going to hold up to heavier items like a hatchet or axe. The weight of this equipment is going to strain and stretch the lanyard, causing it to fail in the end.

These days, there are a number of companies that produce lanyards for every day use. If you are a company trying to promote a product or service, a lanyard can have your company logo printed on it. This is a cheap and effective way to advertise, because for just pennies you can give them away to customers. Since customers tend to use lanyards every day, your logo will be displayed prominently around their neck or wrist, or even on a back pack.

There are a number of uses for lanyards. Surprisingly, lanyards are used all the time to moor boats and canoes, for securing commonly used items to back packs and even for securing luggage, skis, and bicycles to the tops of vehicles, just to name a few. Even a bungee cord can be considered a lanyard, because it is used for securing down items you don’t want to lose.
